Австрийская конституционная реформа 2008 года

Аннотация
В 2008 году в Австрии была осуществлена первая после вступления страны в 1995 году в ЕС крупная конституционная реформа. Положения первой части рефор- мы затронули внешнеполитическую сферу деятельности государства - правовое регулирование государственных договоров, передачу суверенных прав и изменение государственных границ. Вторая ее часть посвящена созданию двухзвенной си- стемы административных судов (административной юстиции), а третья часть содержит регулирование в сфере органов парламентского контроля, которое затрагивает Счетную палату, прокуратуру и создание института «судебного защитника» (Justizanwalt). В данной статье излагаются концептуальные основы системы конституционного права Австрии, анализируются положения конституционных новелл.
